In civil proceedings, our lawyers have acted on letters rogatory applications and similar requests to and from foreign judicial authorities for the compulsion of evidence across borders. We have also sought and enforced orders for the taking of commission evidence abroad for use in Canadian litigation.

For example, our partner Aaron Dantowitz was retained by U.S. counsel to provide an expert opinion on the Ontario courts’ treatment of confidential information associated with requests for international judicial assistance to obtain the production of documents.

As part of our specialized criminal practice, we have also acted in numerous proceedings under the Mutual Legal Assistance in Criminal Matters Act and the Extradition Act, representing individuals and companies targeted by foreign criminal investigations or proceedings.

Where appropriate, we negotiate with Canadian or foreign authorities in evidence-gathering proceedings or search and seizure issues. When necessary, we litigate these issues vigorously on behalf of our clients.
