Justin Safayeni has published a case comment in the latest issue of the Advocates’ Quarterly journal. Titled “Improving the Effectiveness of the Constitutional Damages Remedy: Vancouver (City) v. Ward”, the case comment explores the application of constitutional damages in the five years since the Supreme Court of Canada’s decisions in Ward, and suggests some legal clarifications and practical improvements to the remedy.
